1. About JayLee Projects

JayLee Projects is a property-services business operated by Jay Lee, trading as JayLee Projects, as a sole trader.

Business address: Bradshaw View, Queensbury, BD13 2FF

Telephone: 07443 830740

WhatsApp: 07799 894555

Email: jaylee4168@gmail.com

These terms apply to enquiries, estimates, quotations and services supplied by JayLee Projects.

Nothing in these terms removes or limits your statutory consumer rights.

2. Services

JayLee Projects provides property repair, maintenance and improvement services. These may include:

  • Joinery and carpentry.
  • Decorating.
  • General repairs and maintenance.
  • Fencing and gates.
  • Garden improvements.
  • Small property refurbishments.
  • Other work agreed in writing.

We may decline work that is outside our experience, availability, service area, equipment or insurance arrangements.

Specialist work may need to be completed by an appropriately qualified or registered contractor.

3. Website enquiries

Submitting a website form, sending photographs, arranging an initial discussion or asking for an estimate does not automatically create a contract.

Information provided through the website is general and should not be treated as a confirmed price or booking unless we state otherwise in writing.

A contract will normally begin when:

  • We provide a written quotation or written description of the agreed work.
  • You confirm that you accept it.
  • We confirm the booking, start date or acceptance.

Confirmation may take place by email, text message, WhatsApp, website acceptance or another agreed written method.

4. Estimates and quotations

An estimate is an approximate indication of the likely price based on the information available at the time. It is not a fixed price.

A quotation is a price for the work specifically described in the quotation, subject to these terms and any conditions or exclusions stated in it.

Unless stated otherwise, quotations remain valid for 30 days.

A quotation may change where:

  • You request additional or different work.
  • Measurements or information supplied were inaccurate.
  • Important information was missing.
  • Hidden defects or damage are discovered.
  • Unsafe conditions are found.
  • Additional preparation is required.
  • The condition of surfaces or structures differs from what could reasonably have been seen.
  • Material quantities, specifications or prices change before acceptance.
  • Additional work is required to meet legal or safety requirements.

We will explain material changes and seek your agreement before carrying out chargeable additional work, except where immediate action is reasonably required to prevent danger or serious property damage.

5. Scope of work

The quotation will describe the work included.

Anything not expressly included in the quotation is excluded unless later agreed in writing.

You are responsible for checking the quotation, including:

  • The description of the work.
  • Materials and finishes.
  • Measurements.
  • Colours and product choices.
  • Areas included or excluded.
  • Waste removal.
  • Preparation work.
  • Start and completion arrangements.
  • Price and payment terms.

Decorating, filling and repair work may not completely remove signs of previous damage, staining, movement, unevenness or differences between old and new materials unless full replacement or specialist preparation is included.

6. Prices and VAT

Prices will be stated in the estimate or quotation.

VAT will only be added where it is legally applicable and expressly stated.

The price may include labour, materials, delivery, disposal or other costs as described in the quotation.

Any additional work or materials will be charged at the price agreed with you.

7. Deposits and advance payments

We may require a deposit or advance payment to:

  • Reserve time in the diary.
  • Purchase materials.
  • Secure made-to-measure or special-order items.
  • Cover initial project costs.

The amount and payment date will be shown in the quotation.

A deposit forms part of the total contract price.

Where you cancel, we may deduct reasonable costs already incurred, including:

  • Work already completed.
  • Materials ordered or supplied.
  • Non-returnable or specially manufactured items.
  • Reasonable supplier cancellation or restocking charges.
  • Other losses that could not reasonably have been avoided.

Any remaining balance will be refunded.

A deposit will not be retained as an arbitrary penalty.

8. Customer responsibilities

You agree to:

  • Provide accurate information about the property and the required work.
  • Confirm that you own the property or have authority to approve the work.
  • Identify known defects, hazards, asbestos or unsafe materials.
  • Tell us about known pipes, cables, drains or hidden services.
  • Provide safe and reasonable access at agreed times.
  • Arrange keys or access permissions where required.
  • Keep the work area reasonably clear where requested.
  • Keep children, pets and visitors away from active work areas.
  • Provide reasonable access to electricity, water and toilet facilities where required.
  • Obtain landlord, freeholder, planning, building-control or other permissions unless our quotation specifically includes this.
  • Secure or remove fragile, valuable or personal belongings near the work area.
  • Make agreed decisions about materials, colours and finishes promptly.

Additional time or cost caused by inaccurate information, restricted access, delayed decisions or undisclosed conditions may be chargeable.

9. Start dates and completion times

We will make reasonable efforts to start and complete work within the agreed period.

Unless expressly confirmed as fixed, start and completion dates are estimates.

Work may be delayed by:

  • Severe weather.
  • Drying or curing times.
  • Material shortages.
  • Supplier or delivery delays.
  • Hidden defects.
  • Additional work.
  • Customer-requested changes.
  • Restricted access.
  • Illness or emergency.
  • Events outside our reasonable control.

We will tell you about significant delays and arrange a revised date where reasonably possible.

Time will not be treated as the essence of the contract unless expressly agreed in writing.

10. Materials

Materials will be those described in the quotation or a reasonably equivalent alternative agreed with you.

Natural materials such as timber and stone may vary in:

  • Colour.
  • Grain.
  • Texture.
  • Moisture content.
  • Knots.
  • Pattern.
  • Weathering.
  • General appearance.

These natural variations are not necessarily defects.

Where a specified item becomes unavailable, we will discuss a reasonable alternative before using it where the difference is significant.

Unused materials purchased specifically for the job remain the property of JayLee Projects unless they have been charged to and paid for by you.

11. Customer-supplied materials

Where you provide materials, fixtures or equipment:

  • You are responsible for making sure they are suitable and complete.
  • They must be available when needed.
  • We are not responsible for manufacturing defects or missing components.
  • We are not responsible for unsuitable specifications that could not reasonably have been identified beforehand.
  • Additional time caused by incorrect, damaged or incomplete items may be chargeable where agreed.

We remain responsible for taking reasonable care when handling and installing customer-supplied items.

12. Hidden or unexpected conditions

Repair and refurbishment work may reveal conditions that could not reasonably have been seen before work began, including:

  • Damp.
  • Rot.
  • Structural movement.
  • Unsafe wiring.
  • Defective plumbing.
  • Unstable surfaces.
  • Hidden pipes or cables.
  • Asbestos-containing or potentially hazardous materials.
  • Insect or pest damage.
  • Previous poor-quality repairs.

Where this happens, we may stop the affected work and explain the issue.

We may provide a separate price or estimate for additional work.

We will not normally continue with chargeable additional work without your agreement.

Immediate temporary action may be taken where reasonably necessary to prevent danger, water damage or serious property damage.

13. Changes and additional work

Changes should be agreed in writing by email, text message, WhatsApp or an updated quotation.

The agreement should record, where relevant:

  • The work being added, removed or changed.
  • The additional or reduced price.
  • Changes to materials.
  • Changes to the expected completion date.
  • Any additional deposit required.

Small changes may be agreed through written messages rather than a formal replacement quotation.

14. Workmanship and statutory rights

We will carry out services with reasonable care and skill.

Materials supplied by us will be appropriate for their stated purpose, subject to their manufacturer's specifications and normal limitations.

Nothing in these terms excludes your rights under the Consumer Rights Act 2015 or other applicable consumer law.

Where work does not meet the agreed standard, please tell us promptly and allow us a reasonable opportunity to:

  • Inspect the work.
  • Investigate the concern.
  • Carry out appropriate remedial work.

Depending on the circumstances, your legal remedies may include repeat performance or an appropriate price reduction.

15. Minor defects and snagging

Minor snagging issues should be reported as soon as reasonably possible after completion.

You should provide:

  • A description of the problem.
  • Relevant photographs where possible.
  • Reasonable access for inspection.

We will assess whether the issue results from our workmanship, normal material movement, wear and tear, misuse, another contractor or an unrelated property defect.

16. Payment

Payment terms will be shown on the quotation or invoice.

Unless otherwise stated, invoices are payable within seven calendar days.

Payment should be made using an agreed payment method.

You should raise any genuine invoice query promptly.

The undisputed part of an invoice remains payable.

Where payment is overdue, we may:

  • Remind you that payment is outstanding.
  • Pause uncompleted work after giving reasonable notice.
  • Decline further work.
  • Recover reasonable debt-recovery or legal costs where lawfully permitted.
  • Claim interest where legally permitted.

Goods or materials that have not been permanently installed may remain the property of JayLee Projects until paid for in full.

17. Consumer cancellation rights

Where a consumer contract is agreed entirely online, by telephone or away from our business premises, you will normally have 14 days from the date the contract is made in which to cancel without giving a reason, subject to applicable legal exceptions.

You may cancel by email, text, WhatsApp, letter or another clear written statement.

Where you expressly ask us to begin work during the 14-day cancellation period:

  • You must pay a proportionate amount for work completed before cancellation.
  • You may need to pay for materials already ordered, supplied or installed where legally permitted.
  • Your cancellation right may end once the service has been fully completed, provided you expressly requested early performance and acknowledged this consequence.

Special rules may apply where you specifically request an urgent visit for repairs or maintenance.

These cancellation rights are separate from your rights where work is faulty, misdescribed or not completed with reasonable care and skill.

18. Cancellation after the cooling-off period

After any statutory cancellation period has ended, you may cancel by giving reasonable notice.

You will be responsible for:

  • Work completed up to the cancellation date.
  • Materials ordered or supplied.
  • Non-returnable or specially made items.
  • Reasonable supplier charges.
  • Reasonable losses that could not have been avoided.

Where we cancel for reasons not caused by you, we will refund advance payments relating to work or materials not supplied.

We may end the contract where:

  • You do not provide safe or reasonable access.
  • You do not make payments when due.
  • You behave abusively or threateningly.
  • The site is unsafe.
  • The work is unlawful.
  • Necessary information or permissions have not been provided.
  • Continuing the work would place people or property at unreasonable risk.

We will give reasonable notice where circumstances allow.

19. Waste and cleaning

We will leave the immediate work area reasonably tidy.

Removal of rubble, packaging, old fittings, garden waste or other materials is included only where stated in the quotation.

Hazardous waste, asbestos, chemicals and specialist waste may require a separate licensed contractor.

General household waste and items not created by our work remain your responsibility.

20. Subcontractors and specialists

We may use a trusted subcontractor or specialist where reasonably necessary.

We remain responsible for work supplied under our contract unless you separately appoint and contract directly with another tradesperson.

Work requiring specialist certification or registration will only be included where stated in the quotation.

21. Photographs

We may take photographs to record:

  • Existing property conditions.
  • Measurements.
  • Work in progress.
  • Completed work.
  • Defects, variations or disputed issues.

We will ask permission before using identifiable project photographs for public marketing where permission is required.

You may refuse marketing photography without affecting the service provided.

22. Damage and liability

We are responsible for foreseeable loss or damage caused by our breach of contract or failure to use reasonable care and skill.

We are not responsible for loss or damage caused by:

  • Pre-existing defects.
  • Hidden defects that could not reasonably have been identified.
  • Incorrect information supplied by you.
  • Undisclosed pipes, cables or services.
  • Defects in customer-supplied materials.
  • Another contractor or unauthorised person.
  • Your failure to follow reasonable care instructions.
  • Normal movement, settlement, shrinkage, expansion or weathering of materials.
  • Events outside our reasonable control.

Nothing in these terms excludes or limits liability for:

  • Death or personal injury caused by negligence.
  • Fraud or fraudulent misrepresentation.
  • Breach of statutory consumer rights.
  • Any liability that cannot lawfully be excluded.

We are not responsible for purely commercial loss, loss of profit or loss of business opportunity where you are acting wholly or mainly for business purposes, except where the law does not allow such liability to be excluded.

23. Complaints

Please raise any concern as soon as reasonably possible.

Contact:

Telephone: 07443 830740

WhatsApp: 07799 894555

Email: jaylee4168@gmail.com

Address: Bradshaw View, Queensbury, BD13 2FF

Please explain:

  • The work concerned.
  • What you believe is wrong.
  • When you first noticed it.
  • What outcome you are seeking.

We will review the matter, inspect the work where appropriate and try to agree a practical solution.

Except in a genuine emergency, you should normally give us a reasonable opportunity to inspect and correct work before instructing another contractor to alter or remove it.

24. Website content and images

Website descriptions are general information and do not replace a job-specific quotation.

Photographs may be:

  • Photographs of completed work.
  • Representative examples.
  • Supplier or licensed images.
  • Digitally created or illustrative images.

Illustrative or digitally created images show possible styles or types of work and should not be treated as evidence that the specific displayed project was completed by JayLee Projects.

Colours and proportions may appear different depending on the device, lighting, materials and property.

Website content may be updated, changed or removed without notice.

25. Reviews

We may invite you to provide an honest review following completion of work.

Reviews may be displayed on the website, social media or third-party review platforms.

We will not materially change the meaning of a review. We may correct obvious spelling errors or shorten a review for display, provided its meaning remains accurate.

26. Intellectual property

The JayLee Projects name, branding, original wording, original photographs and website content belong to JayLee Projects or are used with permission.

Content may not be copied, republished or used commercially without written permission.

27. Events outside our control

Neither party will be responsible for delay or failure caused by events they could not reasonably control.

The affected party should notify the other as soon as reasonably possible.

Both parties will try to agree revised arrangements.

28. Severability

If any part of these terms is found to be unlawful or unenforceable, the remaining terms will continue to apply.

29. Governing law

These terms are governed by the laws of England and Wales.

Consumers retain the right to bring proceedings in any court available to them under applicable consumer law.

30. Changes to these terms

The version applying to your job will normally be the version provided or available when you accepted the quotation.

Later changes will not apply retrospectively unless both parties agree.
